The notary makes an appointment to prepare the notarial acts to be done, which include juridical and fiscal counselling.
To execute a notarial act presupposes that the parts clearly explain what they need for the notary, knowing their will, to fully reinterpret it and adapt to the juridical ordinance.
According to Mouteira Guerreiro, the notary’s job is “to inquiry, to probe by executing (not only by listening), to fully examine what the parts want and tell to be written and consigned what they really expect”.
The execution of the act presupposes the parts are aware of all the implications, those related to taxation and registration, before having executed it.
